Terms and conditions

Definitions

  • Medical Topix, established in Amsterdam.
  • Customer: the party which Medical Topix has entered into an agreement with.
  • Parties: Medical Topix and customer together.
  • Consumer: a consumer who is an individual acting for private purposes.

Applicability

  • These terms and conditions will apply to all quotations, offers, activities, orders, agreements and deliveries of services or products by or on behalf of Medical Topix, including use of the website and any purchases made, by or on behalf of Medical Topix.
  • Parties can only derivate from these conditions if they have explicitly agreed upon in writing.
  • The parties expressly exclude the applicability of supplementary and/or deviating general terms and conditions of the customer or of third parties.

Prices

  • Medical Topix is entitles to adjust all prices for its product or services, shown in its shop, on its website or otherwise, at any time prior to the completion of an order.
  • The parties agree on a total price for a service provided by Medical Topix.
  • Products are immediately paid for.

Returns

  • A custumor may return an online purchase during a period of 14 days without giving any reason provided that:
    • The product has not been used
    • The product is not specially tailored for the consumer or adapted to its special needs
    • The product is not digital
  • The return policy of 14 days commences on the day after the consumer has received the last product or part of 1 order.
  • The consumer can notify his right of withdrawal via contact@medicaltopix.com to get the withdrawal form.
  • The consumer is responsible for the return shipping costs, unless otherwise specified.
  • If the purchase costs and delivery costs are eligible for reimbursement according to the law, Medical Topix will refund these costs to the consumer within 14 days of receipt of the timely appeal to the right of withdrawal, provided that the consumer has returned the product to Medical Topix in time.

Delivery

  • Any delivery period specified by Medical Topix is indicative and does not give the consumer the right to dissolution or compensation if this period is not met with, unless the parties have expressly agreed otherwise in writing.
  • Medical Topix is not responsible for any delays in delivery caused by third-party couriers or circumstances beyond our control.
  • The delivery starts once the customer has fully completed the (electronic) ordering process and received an (electronic) confirmation of the order from Medical Topix.
  • If the package of a delivered product is openend or damaged, the customer must have a note drawn up by the forwarder or delivery person before receiving the product.

Complaints

  • The customer must examine a product or service provided by Medical Topix as soon as possible for possible shortcomings.
  • Customers must inform Medical Topix within one month after detection of the shortcomings.
  • Customers must provide proof of purchase when submitting a complaint.
  • The customer gives a detailed description as possible of the shortcomings, so that Medical Topix is able to respond adequately.
  • The customer must demonstrate that the complaint relates to an agreement between the parties.

Changes in general terms and conditions

  • Medical Topix is entitles to amend or supplement these general terms and conditions.
  • Changes of minor importance can be made at any time.

Limitations of liability

  • Medical Topix is not liable for any damage, loss, or costs arising from circumstances beyond our control, including but not limited to force majeure, technical failures, or third-party errors (such as internet service providers or delivery services).
  • We strive to ensure the quality of our products, services, and website. However, we cannot be held responsible for temporary unavailability, errors, or inaccuracies on the website.
  • The use of the website and services is at the user’s own risk. Medical Topix is not liable for any damages arising from the use of the website, unless caused by willful misconduct or gross negligence on our part.
  • Our liability is always limited to the amount paid under the relevant agreement, or the actual value of the product or service provided.

Applicable law and competent court

  • Dutch law is exclusively applicable to all agreements between the parties.
  • The Dutch court in the district where Medical Topix is established is exclusively competent in case of any disputes between parties, unless the law prescribes otherwise.
